1. Overview

Board Exchange specialises in selling second-hand surfboards on consignment. Sellers leave their boards with us, and when sold, receive their payment minus a commission retained by Board Exchange. Due to the nature of our products — used surfboards — and our consignment model, we do not offer returns or refunds on purchases.

2. Legal Framework

In accordance with Portuguese consumer law and the European Union Consumer Rights Directive (2011/83/EU), consumers have the right to withdraw from distance contracts (online purchases) within 14 days from the date they receive the goods. However, this right may be limited or excluded for certain goods, including used goods or items personalised or made to order.

Given the second-hand condition of our products and practical considerations, we rely on the following legal provisions:

  • Article 9 of the Portuguese Consumer Rights Law (Decree-Law 24/2014, implementing the EU Directive), which excludes the right of withdrawal for goods liable to deteriorate rapidly, which are not suitable for return.

  • The right of withdrawal applies strictly to online and distance purchases

3. Returns for Online Purchases (Distance Selling)

If you purchased a board online, you have the right to request a return within 14 calendar days following receipt of the item. To exercise this right, the following conditions must be met:

  • The board must be returned in the same condition as received, without any damage or signs of use.

  • You must return the board at your own cost and risk to our warehouse location in Portugal.

  • The board must be shipped back in its original packaging or packaging of equal protective quality to avoid damage.

Please note: If the board is returned damaged or used, or not returned at all, no refund will be issued.

4. No Returns or Refunds on In-Person Purchases

For items purchased in-person, at our warehouse or any physical sales point, all sales are final, and no refunds or returns will be accepted.

5. Reselling Under Our Consignment Model

If you changed your mind and wish to sell your recent purchase after purchase, you are welcome to consign your board to Board Exchange under the usual terms:

  • Leave your board with us for resale.

  • When the board sells, you receive the sale price minus our commission.

  • This is currently the only method we offer to “return” a purchase, by re-listing it for sale through our platform.

6. Exceptions & Damage During Shipping

In case of damage incurred during shipping:

  • You must notify us within 3 days of delivery, providing photographic evidence.

  • We offer optional Shipping Damage Cover for €20–30 per order, which covers repair costs caused during transport.

  • Claims without Shipping Damage Cover are subject to individual assessment and are generally not eligible for refund or replacement.
